30 June 2013. CDA Raul H. Dado reports that ATN Officers Mar Hassan and Madayao Lucman rescued two Filipinos on 28 and 29 June after distress calls were received by the Embassy Legal Desk.

One of the women, Joy (not real name), had been arrested during the checking. She was not brought to the police station but was forced to work in the residence of the brother of the police officer, instead. Another police officer brought her to an Ethiopian recruitment agency in Fahaheel where she was found by the ATN Officers and brought to the Embassy.

The second woman, Karen (not real name), was rescued after a call received by Ms. Thea Nabo, administrative staff of the embassy, was relayed to ATN officers Hassan and Lucman who immediately searched for her in Fahaheel and was brought to the embassy. The two are now in the custody of POLO-FWRC.

CDA Dado Carries Investigation of Sex-For-Fly to Philippines; Labatt Dicang Continues Investigation in Kuwait

20 June 2013. Philippine Embassy Kuwait has taken the investigation to Manila as Chargé d’ Affaires, a.i. Atty. Raul H. Dado meets with Secretary Albert F. Del Rosario over the weekend.

PE Kuwait had immediately convened on investigation as soon as word of the alleged scandal broke out in early June. A witness has named some personnel with conduct unbecoming but none have testified on Sex-For-Ticket solicitations. The investigation panel has asked the public and complainants for their affidavits in a free and open investigation. These potential complainants and victims may be in the Philippines.

In several pronouncements, Philippine Embassy officials have expressed indignation at the events and have instituted measures to stop any future eventualities. Part of these measures is the ongoing investigation in Manila.

Labatt Des Dicang continues the investigation in Kuwait.

A Composite Legal Team of embassy and labor officials and case officers will tackle OFW cases in a comprehensive and united approach to ensure all avenues are explored towards just resolution of cases. These cases range from maltreatment to sexual and physical abuse.

The team will be working with select local lawyers of known integrity and competence. Abused OFWs will not be asked to pay fees or commissions to lawyers. They may also change or choose their own lawyers if they wish.
Legal fees will be taken from arbitral awards decreed by a judge or an adjudication mechanism at the investigation level. OFWs will not pay these fees. The local lawyers will work for awards that are just.

This protocol or procedure in working with local lawyers will promote transparency in embassy and Philippine labor office legal assistance.

Also, OFWs will not be forced to settle but will be advised to file cases and go all the way to prosecution.

In a wider context, the Legal Team will study the existing sponsorship or ‘kafala’ system in Kuwait to assess see if Filipino domestics should still come here. In the sponsorship system, the domestics stay inside the homes where they work. It is inside homes where abuse occurs. In other jurisdictions, domestics ‘stay-out’ and regularly report for work.
